The Client, (also referred to as 'User' or 'You'). If this agreement is accepted on behalf of a company or other legal entity, the individual represents that they have the authority to bind such entity to these Terms and Conditions; in which case, 'The Client', 'User', or 'You' shall strictly refer to that entity.

Confidential Information, shall mean all data, materials, and proprietary information including, without limitation: software, source code, databases, protocols, business processes, interface specifications, and documentation, whether shared in written, digital, oral, or any other medium. This obligation of confidentiality shall remain in effect even after the termination or expiration of this agreement.

1. General Conditions

1.1. You may access this website without registering your details.

2.4. All data on this website is processed electronically and securely by Joseba Mirena, the technical service provider. As the technical provider, Joseba Mirena does not share or sell your personal data and maintains appropriate security measures under current legislation to protect your privacy.

2.5. Personal data shall be retained only for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements.

2.6. In accordance with GDPR, CCPA, and applicable data protection laws, all Clients and Users may exercise their rights to access, rectify, delete, restrict, or object to the processing of their data, as well as the right to data portability. 2.7. Any communication from Joseba Mirena and all attached documents are subject to professional confidentiality and are strictly confidential. They are intended solely for the recipients. Disclosure, copying, or distribution to third parties without prior written consent is strictly prohibited.

3. Responsibility

3.1. Joseba Mirena provides information about its services and this information is contractual, except for typographical errors.

3.2. Joseba Mirena may review any information or material submitted by its users. It is strictly prohibited to share any obscene, racist, demeaning, or defamatory data, or any material that violates the laws of the Spain or the rights of others. Violation may result in the restriction of your access.

3.3. Joseba Mirena seeks to ensure the highest quality in all its online services, but given their technical complexity, offers a service "as is," without taking responsibility for any loss or damage arising from the use of the information provided herein.

3.4. Joseba Mirena may terminate or suspend your access to all or part of this service without notice for any conduct which, in its sole discretion, is deemed to be in violation of applicable law or harmful to the interests of another user, third party, or this website.

4. Business Solutions

4.1. WHEREAS, the Client wishes to purchase products and/or Services from Joseba Mirena. The Client declares and warrants that they are eligible and have the right to enter into this contract in accordance with the laws of their country.

4.2. Joseba Mirena, at its sole discretion, expressly reserves the right to, without prior notice or any refund or compensation, remove, suspend, deny, cancel, modify, intercept and analyze traffic, redirect, log usage, monitor, block access, limit access to, take possession of, or transfer any service, or modify access to the Client's services.

4.3. The Client must pay 100% of the final price of the requested services in advance; this payment is non-refundable.

4.4. The Client must ensure that all necessary information and digital files for developing each Business Solution or design are available to Joseba Mirena within seven (7) calendar days from the project start date. Failure to comply results in the forfeiture of any rights or deposits paid, and the Client must request a new service.

4.5. The Client warrants they own or have legal permission for all graphic material provided. The Client explicitly assigns copyright of said materials to Joseba Mirena, granting permission for its use in any manner deemed appropriate, including commercial purposes.

4.6. All designs, codes, images, and web resources hosted on Joseba Mirena systems are copyrighted and protected; the Client may not use them outside these systems without express written authorization.

4.7. The Client may cancel any renewable Business Solution by providing notice at least 30 business days prior to its expiration; otherwise, the service will be automatically renewed.

4.8. The Client is solely responsible for the timely renewal of any service or product. If payment is not successfully processed prior to the expiration date, a penalty fee equivalent to 50% of the services' or products' final price will be applied to restore or maintain the active status.
